  • The unconstitutional change of government is becoming an international crime and being sanctioned as such by an international criminal court in Africa. Indeed, the unconstitutional change of government is one of the phenomena which undermine democracy, peace, security, stability and development in African States. Becoming aware of this irrefutable fact, the African Union, as well as several other international organization, commenced a movement of prohibition and sanction of the unconstitutional change of government. This movement hardens and legally develops at present, leading to the crystallization of an international crime of unconstitutional change of government in the protocol on the statute of the African Court of justice and human rights. This court received power to try persons for this new international crime of unconstitutional change of government, starting from the entry in to force of the Statute of the court, which will hopefully take place as soon as possible.
