    La prueba del dominio no es algo 'diabólico'. Ella depende de si lo discutido es la titularidad o el ejercicio del derecho y no de haber probado que éste pudo adquirirse por medio de la prescripción. Este artículo examina cómo las acciones reales anticipan esas exigencias de prueba, así como el rol que en ella cumplen la posesión y la inscripción conservatoria tratándose de inmuebles. En el caso chileno la prueba del dominio es una decisión guiada por reglas -judiciales y legales- que limitan la soberanía del juez.

    The proof of the domain is not 'evil'. It depends on whether the ownership or the execution of the right is being discussed and not that this it has been acquired by prescription. This article examines how the actions in rem anticipate these proof requirements, and the role that the possession and the property registration of things play on them. Chilean practice shows that the proof of the domainis a decision guided by rules -judicial and legislative- that limit judicial sovereignty.
