La nueva delimitación del concepto de trabajador autónomo del sector marítimo-pesquero en la Ley 47/2015, de 21 de octubre

    El objetivo del presente estudio es el de establecer las fronteras que delimitan el concepto de trabajador autónomo y asalariado del sector marítimo-pesquero, en función de su integración en el Régimen Especial de Trabajadores del Mar, para determinar el grado de flexibilización que se ha producido en el concepto de “trabajador autónomo”. Para ello, efectuamos un análisis comparativo entre la Ley 47/2015, de 21 de octubre y el derogado Decreto 2864/1974, de 30 de agosto y de la jurisprudencia que viene determinando las fronteras entre el empleo autónomo y asalariado en el sector marítimo-pesquero. Pretendemos, así, determinar si esta frontera se ha reducido o ampliado, tomando como hipótesis de partida que se ha producido un redireccionamiento hacia el ámbito del autoempleo en esta nueva norma, al ser más amplio el concepto del trabajador autónomo. Comparamos, también, esta nueva situación con la que se mantiene en el ordenamiento jurídico italiano en relación a los pescadores autónomos.

    The object of this study is to establish the boundaries delimiting the concept of self and salary employed and maritime and fishery, depending on their integration in the Special Regime for Sea Workers sector to determine the degree of flexibility that has occurred the concept of "self-employed". To this end, we conducted a comparative analysis of the Law 47/2015 of 21 October and repealed Decree 2864/1974, of 30 August and jurisprudence that is determining the boundaries between self-employment and wage-maritime sector in the fishing. We intend thus determine whether this border has been reduced or expanded, on the hypothesis that there has been a redirection to the field of self-employment in this new standard, being broader concept of self-employed. Compare, also, this new situation that remains in the Italian legal system in relation to self-employed fishermen.
