    • Subrogation is a legal complex form that has been regulated so heterogeneous in the domestic legislation of the Member States of the European Union. In this sense, the fact that the Community legislature has included the subrogation in the Council Regulation 593/2008 is for the community legal order and, more specifically, for the scope of the applicable law, the recognition of a independent legal form, similar to the transfer of credits but different of this last one that can be used by the contracting parties. This regulation was necessary because, first, the figure was not regulated in all domestic systems and, secondly, because in the jurisdictions where subrogation is used, is not regulated in the same way and we may find one or two types of subrogation, depending on the State.
