En el Derecho de Patentes existe un principio en virtud del cual la invención y, consecuentemente, el derecho a la patente pertenecen al inventor. También hay un principio básico del Derecho del Trabajo según el cual los resultados, los frutos del trabajo corresponden al empresario. En el presente artículo, vamos a examinar a quien corresponde la invención en el caso de las invenciones laborales. También analizaremos los derechos y deberes contenidos en los artículos 18 y 19 de la Ley de Patentes. Finalmente, trataremos la resolución de los litigios en el ámbito de las invenciones laborales
In the Patent Law there is a principle under which the invention and, consequently, the right to the patent belongs to the inventor. There is also a basic principle of Labor Law according to which the fruits of labor belong to the employer. In this paper, we will analyze to whom the invention corresponds in the case of employees’ inventions. We will also examine the rights and duties contained in articles 18 and 19 of the Patent Act. Finally, we will discuss the settlement of disputes in the field of employees’ inventions.
