A Sociedade do Espetáculo, tal como descrita na abordagem de Guy Debord estendeu-se a todos os setores da vida social. O processo penal que deveria controlar o poder penal sofreu uma mutação. Os julgamentos penais foram transformados em entretenimento para servir à lógica do espetáculo, ela mesma baseada no primado da audiência contra a justiça. Casos penais foram transformados em mercadoria. Na lógica de mocinhos e bandidos, heróis e vilões são eleitos para atender a interesses momentâneos de um enredo em que a lei importa pouco, diante da sustentação da lógica maniqueísta e binária que impede a reflexão crítica. O juiz-diretor controla os atores-espectadores num jogo populista. Ressignificar o processo penal se torna urgente para garantir direitos fundamentais ameaçados neste momento.

The Society of the Spectacle, a concept developed by Guy Debord, has been extended to all walks of social life. The criminal procedure, which should control the criminal power has changed. Criminal trials became entertainment to serve the logics of the spectacle, which is based on the primacy of the audience against the justice. Criminal cases became a commodity. Following the logic of the “good guys versus the bad guys”, heroes and villains are chosen to serve the momentary interest of a plot in which law does not matter. What matters is to maintain the binary logic which hinders the critical reflection. The judge/director controls the spectators/actors in a populist game. It is necessary to reframe the criminal procedure to guarantee the fundamental rights that are being threatened at this moment.
