Entre a imparcialidade e os poderes de instrução no caso Lava Jato: para além da iniciativa probatória do juiz

    The judge’s impartiality is a necessary condition for the due process, producing the protection of the right to a subjectively impartial judge, “applying a standard that does not claim that the party who considers itself damaged credits the existence of a subjective prejudice that is projected into an objectively contrastable result” has profound implications. What characterizes the impartiality of the judge is the verification of “a legally determined distance between the court and the parties” embodying the arbitration nature that defines jurisdiction in modern times. The aim is to assign the trying of the case to the person who can do this as objectively as possible. The judge´s evidentiary initiative has a problematic facet when it crosses with impartiality. In the case of “Lava Jato Operation” this issue has gained a different outline because, not rarely, did it result in judges being induced to produce evidence, a fact which is contrary to the presumption of innocence.

    A imparcialidade do juiz é condição de validade do processo e a produção de proteção ao direito a um juiz subjetivamente imparcial, “aplicando standard que não reclama que a parte que se considere lesionada credite a existência de um prejuízo subjetivo que se projete em um resultado objetivamente contrastável” tem profundas implicações. O que caracteriza a imparcialidade do juiz é a verificação da “distância legalmente determinada entre o tribunal e as partes” que materialize o caráter de árbitro que grava a jurisdição nos tempos modernos. Busca-se dessa maneira atribuir o julgamento do caso à pessoa que esteja em condições de o fazer com a maior objetividade possível. A iniciativa probatória do juiz configura faceta problemática no cruzamento com a imparcialidade. No Caso Lava Jato, a questão ganhou contorno diferenciado porque, não raramente, resultou de induzimento judicial à presunção de inocência.
