Resumen de Zur Reformbedürftigkeit des Schuldrechts im schweizerischen IPRG, insbesondere der Regelungen zur ausservertraglichen Haftung
In 2017, the Swiss Private International Law Act will celebrate the 30th anniversary of its adoption. This anniversary offers the opportunity to raise the question of wheter the Act needs reform. The following contribution analyses this question for the law of obligations, and in particular the provisions on extra-contractual liability. The author submits precise proposals for the reform of several provisions regarding the law applicable to tortious liability (in particular regarding party autonomy in the law of torts, complex torts in general, and recourse between debtors), and the law applicable to contracts (in particular regarding choice of law in battle of forms situations, the law applicable to consumer contracts and to employment contracts), as well as the provision on renvoi in the general part of the Swiss Private International Law Act.
