Resumen de A teoria do delito e o enigma do dolo eventual: considerações sobre a aparente nova resposta italiana

  O conceito subjetivo se encontra no foco central do debate sobre a teoria do delito, principalmente desde um ponto de vista da civil law. Apesar das muitas variações conceituais sobre o tema, o Brasil se manteve, durante muito tempo, afastado dessa discussão. Uma recente decisão do Tribunal Supremo italiano, no entanto, faz caminho inverso a tudo que até agora se discutia, sendo necessário um repensar para que se avalie se o Brasil está, de fato, tão atrasado nesse cenário.

  The subjective concept is the central focus of the debate on the theory of crime, especially from in a civil law background. Despite the many conceptual variations on the theme, Brazil remained for a long time, away from this discussion. A recent decision of the Italian Supreme Court, however, points to a direction contrary to all that has been discussed so far. This decision stresses the necessity of rethinking the subject in order to assess whether Brazil is, in fact, behind other countries in the abovementioned discussion.
