    This article about the authentic interpretation of can. 1367 analyses the criminal offense against the Eu-charist, according to the threefold aspect of the abicere, abducere and retinere. Then there is an exposition concerning the authentic interpretation of the verb “abicere” and one’s analyses the problem of specifc intention in relation to the unlawful removal and retention of the Eucharist. The author devotes large space to the imputability of this crime, its punishment, the mitigating circumstances, the exemption and the problem of complicity.

    Il presente articolo sull’interpretazione autentica del can. 1367 e la problematica del dolo specifico analizza innanzitutto la fattispecie di reato secondo la triplice flessione dell’abicere, abducere e retinere. Segue un approfondimento riguardante l’interpretazione autentica del verbo “abicere” e si analizza la problematica del dolo specifico relativamente all’asportazione e alla ritenzione illegittima. L’Autore dedica da ultimo ampio spazio alla tematica relativa all’imputabilità di tale delitto, alla sua punibilità, alle circostanze attenuanti ed esimenti e al problema della correità.
