En este artículo se realiza un análisis de la posición de la Corte Constitucional colombiana, sobre la fuerza vinculante del precedente constitucional en materia de control de constitucional y de tutela, a partir de la reseña del desarrollo jurisprudencial que se le ha dado desde la creación en 1991 de la Jurisdicción constitucional. El análisis se orienta a poner de presente el conflicto existente sobre las fuentes del derecho, desde un análisis histórico de la rigidez constitucional y el papel de los tribunales constitucionales.

In this article it is realized an analysis of the position of the Constitutional Colombian Court, on the binding force of the constitutional precedent as for control of constitutional and of guardianship, from the review of the jurisprudential development that it has been given since the creation in 1991 of the constitutional Jurisdiction. The analysis is orientated to present the existing conflict on the Sources of Law, from a historical analysis of the constitutional inflexibility and the role of the constitutional courts.
