During the proceeding de libertate, the lawyer is entitled to take copies of the intercepted’s iles founding in the precautionary measure, although not deposited, even if they concern videotapes. Also for videotapes the lawyer must have the possibility to verify the correspondence between the iles and theirs reports If the the public prosecutor has given permission to take copies, he must communicate, timely and personally, to the defender the dificulties that are arising from satisfy his rights.

Nel procedimento de libertate, il difensore ha diritto ad estrarre copia dei supporti magnetici del captato posto alla base della misura cautelare, seppure non depositati, anche quando questi siano costituiti da videoregistrazioni. Per quest’ultime, infatti, sussiste l’esigenza di veriicare l’idoneità del mezzo documentale a rappresentare il fatto registrato. Se il pubblico ministero acconsente alla richiesta del difensore e successivamente sorgono dificoltà ad evadere l’istanza, egli ha l’obbligo instaurare, personalmente e tempestivamente, una fase interlocutoria con la difesa per soddisfare il suo diritto.
