Il giudice, con un ragionamento di natura induttiva, ha ritenuto che il principio espresso dalle Sezioni Unite con sentenza n. 18288 del 2010 possa essere esteso oltre i limiti preclusivi individuati dall’art. 666, comma 2, c.p.p. Osservazioni conclusive in tema di “diritto vivente”, elaborate dalla giurisprudenza in ambito di diritto civile, confermano la correttezza della tesi, la cui applicazione deve però essere subordinata a talune regole di cautela.
The Judge, whose ruling is being discussed in this abstract, by way of inductive reasoning has deemed the principle used by the SC in the Judicial Sentence No. 18288 of 2010, applicable beyond the preclusive limits stated in art. 666 Section 2 of the Criminal Procedure Code. In the context of “living law,” conclusive observations elaborated by the case law in the realm of civil law jurisprudence, conirm the correctness of the principle. However, the application of such principle must be subjected to certain precautionary rules.
