Los derechos fundamentales del ser y la bioética frente al estigma y discriminación del vih/sida: marco legal nacional e internacional

    El presente artículo se circunscribe a la reflexión que generó la construcción del modelo financiero de seguro de vida individual para personas con VIH en Colombia: “Una enfermedad que nos puede afectar a todos” en el marco de los Derechos Humanos de la población en general y de las personas viviendo con VIH/SIDA en particular, que gozan de una amplia protección por parte del Estado, sumada la existencia de una vasta legislación en Colombia, inspirada sobre el marco de acuerdos mundiales. Esta deliberación surge de la revisión de la normatividad promulgada en los ámbitos nacional e internacional. El ejercicio reflexivo del deber ser de la norma, gira en torno a la propuesta de un modelo financiero que demuestre la viabilidad de ofrecer un seguro de vida individual a personas con VIH, donde se desarrollará una metodología mixta, es decir la inclusión tanto cuantitativa como cualitativa. Cuantitativa a partir de datos arrojados por la base para la construcción de gráficas estadísticas indexadas a variables determinantes, y cualitativamente al tener compromiso y conciencia social frente al problema que afrontan no solo las personas portadoras de la enfermedad, sino la sociedad en general. Las encuestas realizadas a tres mil pacientes que viven con VIH, permitieron detectar el comportamiento que ha tenido este virus con datos puntuales y confirmatorios por ONUSIDA y descartar mitos como el promedio de vida que puede llegar a tener una persona, viviendo con VIH/SIDA.

    This article circumscribes to the reflexion generated by the construction of a Health Insurance financial Model for the people diagnosed with VIH in Colombia. “A disease that can affect us all” in the frame of the general population Human Rights, and for the people suffering from VIH/SIDA in particular, who have a broad protection from the State, added to the existence of a wide legislation in Colombia inspired on the frame of global agreements. This deliberation emerges from the revision of the normativity emitted within national and international contexts. The reflexive exercise on the Rules duty to be evolves around the proposal of a financial Model demonstrating the viability of offering Individual Health Insurance to people with VIH where a mixed methodology will be developed meaning the inclusion of qualitative and quantitative approaches. Quantitative, as it will include data produced by the grounds on the construction of indexed statistic graphs to determinant variables; Qualitative, because of the commitment and social awareness towards the problem faced not only by the carriers of the disease but for the society in general. The poll conducted with three thousand patients who live with VIH, allowed us to detect the virus behavior with punctual information confirmed by ONUSIDA and discard the myth around life average for a person with VIH/SIDA.
