  Con el objeto de vislumbrar lo innecesario e inconveniente dela incorporación del daño a la salud dentro de la tipología delos perjuicios inmateriales, se elaboró este ensayo. En el mismose resalta que dicho concepto termina afectando el principiode reparación integral, dado que incorpora concepcionesestándar en torno a la valoración de la integridad psicofísica delser humano sin atender su componente digno, lo que implicagenerar indemnizaciones similares frente a impactos perjudicialesdiferentes. Por otro lado, se explica cómo el perjuicio a la saludes un concepto que confunde los elementos de daño y perjuicios,diferenciación que es esencial en materia de reparación integral.Así mismo, se expone como el detrimento a la salud en elaspecto indemnizatorio de las consecuencias del menoscabo,termina confundiéndose con la afectación a la vida de relación.Finalmente, se esgrime que la metodología que incorpora laaminoración a la salud propugna por una jurisprudencia deconceptos y desconoce la técnica del precedente, técnica queprecisamente se debe fundar en situaciones fácticas para realizarel derecho a la igualdad conforme lo ha expuesto la CorteConstitucional.
