Este trabajo trata sobre el interés superior del menor en los casos de sustracción internacional. El art. 12 del Convenio de La Haya de 1980 establece que, si el procedimiento de restitución ha comenzado cuando ha transcurrido un período de tiempo superior a un año y el menor se encuentra integrado en su nuevo medio, la autoridad competente no está obligada a ordenar el retorno del menor. Si no se cumplen las condiciones del art. 12, la integración del menor en el nuevo medio debería ser tomada en consideración por la autoridad que ostente la competencia para decidir sobre el derecho de custodia.

This article deals with the best interests of the child in cases of international abduction. Article 12 of the 1980 Hague Convention stays that, if a proceeding has been commenced after the expiration of a period of one year and the child is now settled in its new environment, the authority having jurisdiction may not order the return of the child. If the conditions of Article 12 are not fulfilled, the settlement in a new environment should be taken into account by the authority having jurisdiction in matters of rights of custody.
