Derechos humanos y acceso a la justicia, una mirada neoconstitucional

    Hace unas décadas al hablar de Derecho cierta parte de la doctrina remitía directamente a la ley.

    Lo cierto es que a partir del juzgamiento de los crímenes de Nuremberg comienza a sembrarse la idea de que el Derecho no siempre coincide con la ley.

    Es que la Comunidad Internacional reconoce derechos fundamentales inherentes a todos los seres humanos, por el hecho de ser personas y no por ser ciudadanos de un determinado Estado.

    Es así que surge la teoría del neoconstitucionalismo, como una idea superadora del constitucionalismo, que lo contiene pero además busca ir más allá.

    Reconoce la existencia de principios que protegen valores que son fundamentales para toda la sociedad y que sirven como herramienta para que los Magistrados a la hora de fallar puedan ponderarlos en aras de lograr decisiones justas y equitativas.

    Derechos Humanos incorporados a las grandes constituciones del mundo y falta de mecanismos por parte de los Estados para lograr su efectivización serán los temas centrales de este trabajo.

    A few decades ago when speaking of law a certain part of the doctrine referred directly to the law.

    What is certain is that from the prosecution of the crimes of Nuremberg begins to be planted the idea that the right does not always coincide with the law.

    Is that the international community recognizes the fundamental rights inherent to all human beings, by the fact of being people and not to be citizens of a particular State.

    Thus neoconstitutionalism theory, as an overcoming idea of constitutionalism, it contains arises but also seeks to go further.

    Recognizes the existence of principles that protect values that are fundamental for the whole of society and which serve as a tool for the judges at the time of failing to weighting them in the interests of achieving fair and equitable decisions.

    Human rights incorporated in the great Constitutions of the world and lack of mechanisms on the part of the States to achieve its implementation will be the main themes of this work.
