Il nuovo art. 182-septies della legge fallimentare (r.d. n. 267 del 1942) offre, alle Banche i cui crediti rappresentino più del cinquanta per cento dell'esposizione debitoria complessiva, la possibilità di estendere gli effetti dell'accordo di ristrutturazione ad altre banche non aderenti allo stesso accordo. Questa estensione rappresenta una rilevante deroga al principio generale in base al quale il contratto produce effetti vincolanti solo tra le parti e permette di raggiungere il miglior risultato del concordato preventivo.
The new art. 182-septies of Bankruptcy Law (R.D. n. 267/1942) gives to Banks whose credits represents more than fifty per cent of the total exposure of the debtor the possibility to extend the effects of the Agreement stipulated for the regulation of his debts to other Banks that didn't subscribe the same Agreement. This extension allows a relevant exception to the general principle according to the contract produces binding effects only between parties and permits to reach the better success of the arrangement with creditors.
