    Este artículo describe de manera breve y concisa la evolución jurídico-constitucional de la libertad de enseñanza y el derecho a la educación en Chile. Con tal propósito el trabajo se divide en siete partes: 1. La educación en la etapa indiana. 2. La educación bajo los primeros regímenes constitucionales del Chile independiente. 3. La educación y la libertad de enseñanza en las constituciones de 1828 y 1833. 4. El derecho a la educación y la libertad de enseñanza según la Carta de 1925. 5. La forma en que fueron recogidos ambos derechos en la Constitución de 1980. 6. El marco legal. 7. La búsqueda de equilibrios. Por último, el trabajo aporta algunas conclusiones sobre el alcance y contenido de ambos derechos en la Constitución

    This article describes briefly and concisely the legal and constitutional evolution of academic freedom and the right to education in Chile. The pa per is divided in seven parts: 1. Education in the indian period. 2. The education under the first Chilean constitutions. 3. The education and academic freedom in the Constitutions of 1828 and 1833. 4. The right to education and freedom of education in 1925 Constitution. 5. The right to education and freedom of education in 1980 Constitution. 6. The legislative development of both rights. 7. The search for balance. Finally, the article provides some conclusions about the scope and content of these rights in the Constitution
