Resumen de La tutela dei creditori ipotecari fra codice antimafia, normativa bancaria e categorie del diritto civile

The essay analyzes the discipline of the "codice antimafia" related to de protection of credits warranted by security interests. The need of a reflection in a private law perspective derives from the circumstance that the seizure and the confiscation could jeopardize goods and rights of thirds parties, who are not the addressee of the prevention measures. This contribution analyzes the problem -broadly present also in the law in action- with regard both to the traditional categories of private law and to the normative statute of the bank activity.

Il saggio analizza la disciplina del codice antimafia relativa alla tutela dei crediti assistiti da diritti reali di garanzia. L'esigenza di una riflessione nella prospettiva civilistica trae origine dalla circostanza che il sequestro e la confisca potrebbero pregiudicare beni e diritti di soggetti terzi rispetto ai destinatari delle misure di prevenzione. Il presente contributo analizza la problematica, ampiamente presente anche nel diritto applicato, avendo riguardo sia alle categorie tradizionali del diritto civile, sia allo statuto normativo dell'attività bancaria.
