    Nos últimos anos, por efeito dos processos de mundialização e globalização, extraordinárias modificações no plano político, social, empresarial, económico e financeiro tiveram lugar.

    O Homem, a sociedade e os mercados, hoje profundamente integrados, refletem as repercussões, diretas e indiretas, dos avanços e recuos dos tentáculos da Nova Ordem Mundial.

    A nova lex mercatoria apresenta-se como a melhor expressão destas mutações no comércio transnacional, pela sua natureza transnacional, dinâmica, revela-se intensamente multifacetada, pelo que constitui uma realidade jurídica open-ended ou in progress.

    No presente estudo procurámos desenvolver, cientificamente, aquilo a que chamamos, no plano das fontes, o núcleo duro da nova lex mercatoria, os seus diversos afloramentos, desenvolvimentos no curso da história.

    O desiderato fundamental desta investigação é através de um processo dinâmico de sistematização garantir aos juristas e interessados nestas temáticas um acesso esclarecido para uma profunda compreensão da sua natureza e amplitude.

    In recent years, the effect of mondialisation and globalization processes, extraordinary changes in the political, social, business, economic and financial plan took place.

    Man, society and markets, today deeply integrated, reflect direct and indirect impacts of the advances and retreats of the tentacles of the New World Order. The new lex mercatoria represents the best expression these transmutations in transnational trade, by their transnational nature, dynamic, reveals itself intensely multifaceted, reason why constitutes a legal reality open-ended or in progress.

    In this study, we intend to develop, scientifically, what it designates be, in the plane of legal sources, the hard nucleus of new law merchant, their various embodiments and developments in the course of history.
