L’autrice, dopo avere evidenziato – sulla base dei più recenti orientamenti della giurisprudenza di legittimità – come l’ambito applicativo delle regole stabilite dall’art. 63, comma 1, c.p.p. risulti ormai inadeguato, cerca di aprire nuovi spiragli verso interpretazioni più attente alla difesa di chi, in séguito all’acquisizione d’un atto che, formalmente, non ha natura dichiarativa, si trovi coinvolto nella vicenda oggetto di indagine.

The author, after having pointed out – on the basis of the latest trend of jurisprudence of legitimacy – how the applicatory sphere of the rules established by art. 63, paragraph 1, c.p.p., comes out inadequate at this time, tries to open new perspectives towards interpretations more careful to the defence of who, following the acquisition of an act that, formally, doesn’t have declarative nature, find himself involved in the event object of the investigation.
