L. 21st February 2014, n. 10 is the last piece of a mosaic started in 2010, after the first conviction for “overcrowding” imposed by the ECHR. to Italy. It’s too early to say whether the repeated interventions “in order to empty jails” will be assessed by the European Court as structural interventions, although the official data are showing positive results.

La l. 21 febbraio 2014, n. 10 costituisce l’ultimo tassello di un mosaico inaugurato nel 2010, dopo la prima condanna per “sovraffollamento” inflitta dalla Corte di Strasburgo al nostro Paese. È presto per dire se i reiterati interventi “svuotacarceri” saranno valutati dalla Corte europea come interventi strutturali, anche se i dati ufficiali evidenziano un significativo calo di presenze.
