Le garanzie linguistiche nel “giusto processo europeo”: l’omesso interrogatorio dell’arrestato per irreperibilità dell’interprete

    The Court of Cassation returns to the topic of language assistance for an alloglot arrestee, accepting the majority orientation in case law and allowing for the omission of interrogation on the grounds of the unavailability of the interpreter, thus validating the precautionary measure.

    It is, however, to be seen whether such an approach is still permissible in the "European spring" of guarantees for the defence.

    La Corte di cassazione ritorna sul tema dell’assistenza linguistica all’arrestato alloglotta, adeguandosi all’orientamento maggioritario e ammettendo l’omissione dell’interrogatorio per irreperibilità dell’interprete, con conseguente convalida della misura precautelare.

    Si tratta, tuttavia, di capire se un simile orientamento si a ancora ammissibile nella “primavera europea” delle garanzie difensive.
