Il legittimo impedimento della persona arrestata a comparire all’udienza non inficia la legittimità della convalida dell’arresto e del contestuale giudizio direttissimo

    Called to pronounce judgement, on the compatibility and the consequent applicability of the validation of arrest and the contextual summary judgement hearing, of the phrase indicated in art. 391, paragraph 3, code of criminal procedure – by which «the judge proceeds with the interrogation of the arrested or stopped person, unless this person was not able to or has refused to appear, in which case the judge hears the defender» – the Supreme Court has answered affirmatively, underlining the principal of right by which the lawful impediment that does not permit the physical presence of the arrested person at the hea ing is not an obstacle to the request of validation of the arrest and the celebration of the contextual summary judgement, as per art. 558, code of criminal procedure.

    Chiamata a pronunciarsi sulla compatibilità e sulla conseguente applicabilità all’udienza di convalida dell’arresto e del contestuale giudizio direttissimo dell’inciso di cui all’art. 391, comma 3, c.p.p. – per il quale «il giudice procede quindi all’interrogatorio dell’arrestato o del fermato, salvo che questi non abbia potuto o si sia rifiutato di comparire, sente in ogni caso il suo difensore» – la Suprema Corte ha risposto affermativamente, ribadendo il principio di diritto secondo cui il legittimo impedimento che non permette la presenza fisica dell’arrestato all’udienza non è ostativo alla richiesta di convalida dell’arresto e alla celebrazione del contestuale giudizio direttissimo, ai sensi dell’art. 558 c.p.p.
