La objeción de conciencia farmacéutica

    La reciente STC 145/2015 se pronuncia, por fin, sobre un asunto largamente discutido por la doctrina, el de la objeción de conciencia farmacéutica. En ella, el Tribunal Constitucional ampara a un farmacéutico que expresamente manifiesta su voluntad de no disponer y, por tanto, de no dispensar la píldora postcoital, aduciendo sus posibles efectos abortivos. Aunque objeta también a la venta de preservativos «por razones de conciencia», el TC no le ampara en este segundo supuesto. ¿Qué concepción de la objeción de conciencia cabe deducir de este relevante pronunciamiento? ¿Qué novedades aporta con respecto a la jurisprudencia constitucional precedente? Como era de esperar, la STC 145/2015 ha suscitado una viva reacción. El presente trabajo pretende terciar en el debate desde la impresión de que al Tribunal Constitucional, por así decir, no se le ha entendido bien.

    In its recent Decision 145/2015, the Spanish Constitutional Court ruled on whether staff of pharmacies could be granted the right to conscientious objection. The Court upheld the constitutional right of pharmacy staff to conscientiously object to selling the so-called «morning-after pill». The Court, however, did not extend the scope of such a right to the sale of contraceptives. As a result of this decision, regarding a highly controversial matter within Spanish doctrine, what should be understood as the new scope of the right to conscientiously object? How does this decision impact the precedent case-law on the issue? As could be expected, Decision 145/2015 has sparked a lively doctrinal debate. This article intends to contribute to the debate under the assumption that the Constitutional Court’s ruling «may not have been fully understood».
