La denominada «maternidad subrogada» o «gestación por sustitución», constituye una controvertida realidad de claros perfiles ideológicos y morales, a la que el Derecho no es ajena. Constituye una figura no admitida por el Ordenamiento Jurídico español, si bien el problema surge cuando padres españoles suscriben el acuerdo de gestación por sustitución en un Estado extranjero donde sí se permite legalmente y posteriormente desean inscribir la filiación del hijo en cuestión en el Registro Civil español.

The so-called �surrogate motherhood� or �gestation substitution�, is a controversial reality of clear ideological and moral profiles, to which the Law is no stranger. It is a figure not admitted by the Spanish legal system, but the problem arises when Spanish parents carry out a gestation by substitution in a foreign state where this technique is legally allowed and later wish to register the paternity of the child in question in the Spanish Civil Registry.
