Resumen de L’impacte de la revisió judicial i de la LOMCE en el model lingüístic de l’escola catalana: estat de la qüestió

L’article té per objecte analitzar el model lingüístic escolar de Catalunya a partir de les sentències del Tribunal Suprem de 23 i 28 d’abril de 2015 i dels diversos pronunciaments del Tribunal Superior de Justícia i del Tribunal Suprem de l’any 2014, especialment, a partir de la fixació de l’obligació d’impartir un 25% del currículum escolar en llengua castellana com a llengua vehicular.
També s’analitza l’impacte en el model del nou dret a rebre ensenyament en castellà i en l’idioma cooficial de la comunitat autònoma en una proporció raonable, previst a la LOE, i la garantia econòmica desenvolupada per via reglamentària d’aquest nou dret.

The purpose of this article is to analyse the language model in Catalan schools on the basis of the Supreme Court judgements of 23 and 28 April 2015 and the various pronouncements of the High Court of Justice and the Supreme Court in 2014 in particular, by considering the obligation established to teach 25% of the school curriculum in Spanish as the vehicular language.
It also analyses the impact of the model of the new right to receive an education in Spanish and in the co-official language of the autonomous region in a reasonable proportion, envisaged in the LOE, and the economic guarantee of this new right by regulatory means.
