Resumen de Gobierno en funciones y función legislativa

  Las elecciones generales de 20 de diciembre de 2015 han ido seguidas de un largo periodo de Gobierno en funciones, que continuará aún después de la disolución decretada por el Rey por no haberse investido un Presidente de Gobierno en el plazo determinado por la Constitución. El artículo analiza las situaciones inéditas planteadas en la realidad político-constitucional, y en especial si tiene sentido el ejercicio de la función legislativa por un Parlamento sin Gobierno, mediante la toma en consideración de proposiciones de ley que pueden verse abocadas a caducar si aquél se disuelve, o a no coincidir con el programa de gobierno del candidato que finalmente resulte investido.

  The Spanish elections of December 20, 2015 have been followed by a long period of a caretaker government, which will continue be in place even after the dissolution of the parliament and the call for new elections by the King. No candidate has obtained the confidence of the Congress within the time frame established by the Constitution.

  The article analyzes this new situation especially with regard to the question if a Parliament without a Government can exercise legislative powers, by taking into consideration legislative projects which may expire if the parliament is dissolved or if these project do not coincide with the programme of the incoming government.
