    Una de las innovaciones legislativas que aparece en Trento es la indisolubilidad del vínculo matrimonial. Un repaso por la concepción romana de matrimonio, atendiendo principalmente a su definición, y a las etapas por las que atraviesa el divorcio, con sus peculiaridades, darán lugar a que se pueda entender el posterior planteamiento patrístico y teológico de la época medieval. Estas ideas irán tomando forma a través de la codificación canónica y los decretistas hasta llegar a su plenitud en el Concilio de Trento.

    One of the legislative innovations which was firstly present in the Council of Trent, was the one relating to indissolubility of the bond of matrimony. In order to understand the later medieval approach, seen through a patristic and teological perspective, it is essential to review the Roman concept of marriage. In this study we must focus on the own definition of matrimony and follow the different stages of the conception of divorce, and all its pecularities according to Roman Law. These ideas will be firstly shaped through the canonical codification and the work of the decrees makers till their summit in the Council of Trent.
