Resumen de Apontamentos sobre o regime geral dos organismos de investimento coletivo

  The legal frameworks applicable to collective investment schemes and real estate investment funds were subject to an extensive review in the context of the incorporation into Portuguese law of Directive 2011/61/EU, as amended, on alternative investment fund managers, enacted by Law no. 16/2015, of 24 February, which approves the general framework applicable to collective investment schemes, consolidating the two former regimes in one single framework. The amendments to these regimes are multiple, some stemming from an imposition of EU law, others by choice of the national lawmaker. In this article we will address only some of the more significant changes.

  Os regimes jurídicos dos organismos de investimento coletivo e dos fundos de investimento imobiliário foram objeto de uma revisão profunda no contexto da transposição parcial para o Direito português da Diretiva n.º 2011/61/UE, conforme alterada, relativa aos gestores de fundos de investimento alternativo, operada através da Lei n.º 16/2015, de 24 de fevereiro, que aprova o regime geral dos organismos de investimento coletivo que unifica assim aqueles dois regimes num diploma único. As alterações a estes regimes são múltiplas, algumas por imposição comunitária decorrente da referida transposição, outras por opção do legislador nacional. Neste artigo destacamos apenas algumas das alterações mais significativas.
