    La crisis de legitimidad social que afecta a las instituciones representativas exige la búsqueda de soluciones jurídicas constructivas. En este contexto el análisis crítico del contenido material de la iniciativa legislativa popular establecido en la CE y la LO 3/1984 puede aportar soluciones que contribuyan a recuperar la credibilidad en las instituciones. Las conclusiones alcanzadas permiten afirmar la disfuncionalidad de la iniciativa como derecho de participación ciudadano en las instituciones representativas y su necesidad de reforma. La propuesta aquí realizada abarca dos campos complementarios: a) la reforma del artículo 87.3 CE que elimine las limitaciones materiales y racionalice las procedimentales; b) la reforma legal que refuerce la posición de la Comisión promotora en las diferentes fases que dan vida a este derecho.

    The social crisis of legitimacy that concerns to the representative institutions needs to find out for new and constructive legal solutions. The critical analysis of the material content of the legislative initiative established in the CE and the LO 3/1984 may provide some useful solutions that contributes to recover the social credibility in the institutions. We affirm the malfunction of the legislative initiative as a citizen participation right within the representative institutions as well as it is necessity to be improved. Our proposal involves two related fields: a) the reform of the 87.3 CE that removes the material limits as well as reduce the procedural ones; b) the legal reform that reinforce the role of the Comisión Promotora in the different phases that composes this right.
