La sentencia del TG de la UE de 10 de diciembre de 2015 anula la Decisión recurrida por el Frente POLISARIO en lo que se refiere a la aplicación del acuerdo en el territorio del Sahara Occidental. La sentencia establece que el acuerdo recurrido se aplica en el Sahara Occidental, que este territorio no forma parte de Marruecos y que este Estado no es la Potencia administradora del territorio. El Tribunal afirma que, antes de aprobar la Decisión, el Consejo debió asegurarse de que la explotación de los recursos naturales del territorio no fuera en detrimento de sus habitantes y de sus derechos fundamentales, pero elude pronunciarse sobre el derecho aplicable en el territorio.

The judgment of the General Court of 10 December 2015 annuls the Decision appealed by the POLISARIO Front in regards to the implementation of the agreement in the territory of Western Sahara. The decision establishes that resorted agreement is applied in Western Sahara, that this territory is not a part of Morocco, and that this State is not the Administering Power of the territory. The Court said that, before adopting the Decision, the Council should have insured that the exploitation of the natural resources of the territory would not be to the detriment of their inhabitants and their fundamental rights, but it is silent on the law applicable in the territory.
