  Este artículo pretende mostrar algunas consideraciones en relación con los aportes más importantes del Código de Comercio expedido en 1971 a la actividad contractual colombiana. Dichos aportes pueden sintetizarse en que dicho Código no buscó modificar o derogar el Código Civil de 1887, sino que, por el contrario, dio continuidad a las instituciones civiles, actualizándolas y transformándolas, por lo que no se justifica ni tendría explicación alguna realizar una nueva codificación en la materia, sino, más bien, se resalta la necesidad de vigorizar y valorar las normas que tenemos vigentes.

  This paper shows some considerations regarding the most important contributions of the Commercial Code issued in 1971 in the Colombian contracting activity. These contributions can be summarized in that the Commerce Code of 1971 did not seek to amend or repeal the Civil Code of 1887, but, by contrast, was a work which gave it continuity, updating and transforming its institu-tions. So, it is not justified to make a new codification on the subject, but, on the contrary, it is highlighted the need to invigorate and understand the rules we have in place
