Resumen de Exportación de material de defensa a Gobiernos extranjeros

  Con la finalidad de promover la exportación de material de defensa, la Ley 12/2012 y el Real Decreto 33/2014 introducen en el ordenamiento jurídico español un mecanismo contractual asentado sobre dos relaciones jurídicas. Una, instaurada entre el Gobierno español y un Gobierno extranjero en virtud de la cual el Gobierno extranjero solicita al Gobierno de España que realice las gestiones precisas para que un determinado material o tecnología de defensa le sean transmitidos por una empresa ubicada en España. Y una segunda, conforme al contenido del encargo del Gobierno extranjero al Gobierno español, el Ministerio de Defensa celebrará en el tráfico jurídico interno un contrato para que una empresa española suministre dicho material al Gobierno extranjero.

  Analizar las singularidades y características de ambas relaciones jurídicas es el objeto de estudio de este trabajo.

  The Law 12/2012 and the Royal decree 33/2014 are intended to promote export of defence materiel by introducing in the Spanish legal system a contractual mechanism founded under two legal relationships. The first legal relationship is stablished between the Spanish Government and a foreign government pursuant to which the foreign government requests to the Spanish Government to take the appropriate steps to ensure that certain defence materiel and technology is transmitted by a company based in Spain; The second one, is established in accordance with the content of the order requested by the foreign government to the Spanish government. The Ministry of Defence shall conclude a contract, in the internal legal system, with a Spanish company which provides this materiel to the foreign government.
