Resumen de Atroces abactores

  The essay is focused on the expression atroces abactores, which is used in the fifth book of the Pauli Sententiae, as attested by the text of so called Collatio legum Mosaicarum et Romanarum. Several questions are put by the lecture of the fragment, and particularly by the peculiar composition of the fragment, which offers as first category the description of the case of the atroces abactores (i.e. the abactores whose behaviour seems to be particularly grave and dangerous [qui equos et greges ovium de stabulo vel de pascuis abigunt vel si id saepius aut ferro auto conducta manu faciunt]), and as second category the general case of the abactores (i.e. the thieves of country-work animals). The analysis of the Paulus text and the connected questions (for example, about the faithfulness of the text of the Collatio) give to the authors the occasion to make some digression about the elaboration, use and evolution of the several categories of crimes in Roman legal science.

  Il saggio si incentra sull'analisi dell'espressione atroces abactores adoperata nel quinto libro delle Pauli Sententiae, come attestato dal testo della cd. Collatio legum Mosaicarum et Romanarum. La lettura del frammento dà l'occasione per prendere in considerazione diversi problemi, a cominciare dalla peculiare struttura del passo paolino, che colloca prima la descrizione della categoria specifica degli atroces abactores (ossia di quegli abactores il cui comportamento pare connotato da particolare gravità e pericolo sociale [qui equos et greges ovium de stabulo vel de pascuis abigunt vel si id saepius aut ferro aut conducta manu faciunt]), e solo successivamente la categoria generale degli abactores (ossia i ladri degli animali preposti al lavoro dei campi): L'analisi del testo di Paolo e i problemi connessi (per esempio, riguardo all'attendibilità del testo della Collatio) danno l'occasione agli autori di svolgere alcune considerazioni riguardo all'elaborazione, l'uso e l'evoluzione delle diverse categorie di crimini e criminali nella giurisprudenza romana.
