    La cuestión litigiosa de la sentencia objeto de comentario, se fundamenta en la relación contractual entre el Club Baloncesto Fuenlabrada, SAD, y la sociedad USLAN, SLU, sobre los derechos federativos del jugador Bismack Biyombo. En mayo de 2011, el jugador comunica a la entidad deportiva su pretensión de resolver la relación laboral con el Club, debido a que la entidad ha incumplido diversos compromisos con el jugador, en concreto, la autorización de residencia y trabajo. En diciembre de 2011 el Club Bobcats Charlotte de la NBA pacta con Baloncesto Fuenlabrada la liberación contractual del jugador. Por otra parte, el Club de origen del deportista y la sociedad USLAN tenían suscrito un contrato sobre los derechos federativos del jugador por el que el Club abonaría a USLAN el 20% de las cantidades a ingresar por traspaso o venta del jugador. En este contexto, USLAN, SLU, reclama la cuantía correspondiente, sin embargo, ante la situación descrita la entidad deportiva niega la validez del contrato suscrito con la sociedad.

    The litigious question of the sentence object of this remark is based on the contractual relation between the Fuenlabrada Basketball Club, SAD, and the company USLAN, SLU, about the federative rights of the basketball player Bismack Biyombo. On May 2011, the player communicates to the sport entity his intention of resolving his labour relation with the Club, since the club defaulted varied agreements with the basketball player, concretely, the residence and work permission. On December 2011 the NBA´s Bobcats Charlotte Club agreed´s with the Fuenlabrada Basketball Club the player´s contractual liberation. On the other hand, the original Club where the player belonged and the company USLAN had an agreement about the federative rights of the player by which the Club will pay to USLAN the 20% of the incomes for transfer or sale of the player. Within this context, USLAN, demanded their money, nevertheless, facing the described situation the sport entity denied the validity of the agreement.
