Resumen de Die Stellung der Molkereigenossenschaften im Agrarkartellrecht
Durch die grundlegende Liberalisierung des EU-Agrarmarktes in den letzten beiden Jahrzehnten kehrt mit dem Agrarkartellrecht ein lange kaum beachtetes Rechtsgebiet in das Bewusstsein sowohl der Agrarrechtler als auch der Kartellrechtler zurück. Dieses vor mehr als fünfzig Jahren in Kraft getretene Spezialrecht, das bei seiner Schaffung äußerst kontrovers war, kann ohne nähere Kenntnis seiner Entstehungsgeschichte nicht verstanden werden. Seit der Milchpreiskrise 2008/09 und dem aus ihr 2012 hervorgegangenen EU-Milchpaket steht der Milchbereich exemplarisch für die wiederbelebte Diskussion um Reichweite und Auslegung des Agrarkartellrechts. Einen wichtigen Aspekt bilden dabei die Molkereigenossenschaften, die auch in der von 2008 bis 2010 durchgeführten Milchsektoruntersuchung des BKartA eine wesentliche Rolle spielten. Durch den erneuten Milchpreisrückgang seit 2014 besteht derzeit eine Debatte über eine Ausweitung der kartellrechtlichen Ausnahmen des EU-Milchpakets. Die vorliegende Untersuchung skizziert anhand des Milchbereichs die wesentlichen Entwicklungen des Agrarkartellrechts, stellt die aktuell geltende Rechtslage dar und geht auf die jüngsten Diskussionen ein.
The Role of Dairy Cooperatives in the Agricultural Competition Law The Article outlines the story of the role of dairy cooperatives in German und EU antitrust law and identifies the agricultural antitrust rules actually applying to such cooperatives. It is based on the assumption that without a deeper knowledge of the origin of the agricultural antitrust law the present state of that law cannot be understood. The most important development in the recent years was the creation of the so-called EU milk package of 2012. It established on EU level the recognition of producer organizations in the milk sector and annexed a specific exemption for raw milk deliveries from the general cartel ban. These new provisions marked the beginning of an intensive debate in Germany on the pro and cons of dairy cooperatives. Especially the right of the member of such a cooperative to deliver all its milk became controversial. The German Bundeskartellamt started in 2008 a systematic inquiry of the German milk market which focused also on the impact of dairy cooperatives in the milk market chain. Since the end of 2013 milk prices are again decreasing. There exist some signals that in repeating a similar situation in 2008/09 a revision of the EU milk package might happen. Such a revision would trigger a change of the outlined actual state of law and could continue the tendency that the agricultural antitrust law becomes more and more complex than at its beginning
