This paper focuses on the conflict between farmers and the holders of intellectual property in plants (Plant variety rights or Patents) in relation to the use, by the farmers and for propagating purposes, of the product of the harvest which they have obtained by planting, on their own holdings, the protected material. In particular it is examined whether farmers can invoke (and to what extent) the exhaustion of rights and the so-called farmer’s privilege. The study is made contrasting the situation in Europe -and in Spainand in the United States.
