En los casos de gestación por sustitución el padre tiene derecho a optar por la prestación por maternidad a cargo de la Seguridad Social pues existe un nexo entre la naturaleza jurídica de la institución, finalidad de la prestación de maternidad y las Leyes que en el ordenamiento jurídico español regulan la conciliación de la vida laboral y familiar y la efectividad de la igualdad entre hombres y mujeres, como lo establecen los artículos 14 y 39 CE en cuanto a la protección de los menores y la institución de la familia.

In cases of gestation by substitution, the father has the right to apply for the maternity allowance from the Social security because there is a link between the legal nature of the institution, the purpose of the benefit of maternity allowance and the laws governing the reconciliation of work and family life in the Spanish legal system and the effectiveness of equality between men and women as provided for in Sections 14 and 39 of the Spanish Constitution with regard to the protection of minors and the institution of the family.
