    La Guardia Civil, dentro del ámbito de libertad que la Constitución otorga al legislador ordinario, ha sido configurada como un «Instituto armado de naturaleza militar», en el que sus miembros tienen la condición de militares de carrera. Paralelamente, las funciones del Cuerpo son duales: policiales, que son las cotidianas, y militares.

    En este trabajo se analiza la fundamentación y conveniencia de la interacción del carácter militar de la Guardia Civil y sus funciones netamente policiales —no militares—, así como la extensión de la jurisdicción militar en relación con los miembros del Instituto armado, especialmente en el ejercicio de estas tareas diarias o cotidianas de protección de los derechos y libertades de los ciudadanos.

    The Civil Guard, within the area of freedom that the Constitution gives the ordinary legislator, has been configured as an «Armed military nature Institute», in which his members get the status of career officer. At the same time, the functions of the Civil Guard Department are dual: police, that the daily ones, and military.

    In this work, it is discussed the rationale y desirability of the interaction of the military character of the Civil Guard and its purely police duties —non military— as well as the extension of the military jurisdiction in relation to members of the Armed Institute, especially in the exercise of these daily or daily tasks for the protection of the rights and freedoms of citizens.
