¿Presidencialismo o Poder Ejecutivo ambivalente?: De la pertinencia de la noción jurídica para el estudio de los sistemas políticos de América Latina

    A pesar de los límites imprecisos del término "presidencialismo", esta noción permite agrupar fenómenos muy diversos relativos a la afirmación del poder presidencial en un mismo proceso. Pero al hacerlo, discrimina las especificidades del régimen presidencial que, al hacer del jefe de Estado un jefe del Ejecutivo, amalgama la interrogante del poder de ejecución (por definición, subordinado) y la del poder del Estado (por definición, soberano y supremo). Este artículo tratará de analizar, a partir del ejemplo de las últimas reformas constitucionales efectuadas en Bolivia, Ecuador y Venezuela, la pertinencia del uso de la noción de Poder Ejecutivo ambivalente en el estudio de los sistemas constitucionales de América Latina.

    In spite of the vague outline of the notion, the term "presidentialism" allows to regroup various occurrences related to the affirmation of the presidential power within the same process. But by doing it, this notion discriminates the presidential system's specificities that, by converting the head of the State into the head of the Executive branch, mingles the question of the power of enforcement (subordinated by definition) and the power of the State (sovereign and supreme by definition). Through the study of the latest constitutional reforms made in Bolivia, Ecuador and Venezuela, this paper will analyze the pertinence of the use of the notion of ambivalent executive power in the study of Latin America's constitutional systems
