¿Nuevas tecnologías? Viejas explotaciones: el caso de la maternidad subrogada internacional

    La subrogación internacional ha sido vista hasta hace poco tiempo como una práctica ilícita; sin embargo, se está convirtiendo en una práctica común para tener un hijo cuando no se puede conseguir de otro modo. Después de presentar los diferentes tipos de subrogación (internacional) que se pueden llevar a cabo y los términos en los que se ha desarrollado el debate público sobre este tema, considero los aspectos éticos y legales de la subrogación internacional. Me pregunto si es compatible con el principio de vulnerabilidad y con la dignidad y los derechos humanos de las personas afectadas: 1) los niños resultantes de esta práctica, 2) la mujer gestante y 3) los comitentes. Concluyo que una regulación de esta práctica sería insuficiente y que la respuesta correcta es alcanzar un acuerdo universal para prohibirla.

    International surrogacy was seen not too long ago as an illicit practice; however, it is becoming a usual practice to conceive a baby when it cannot be achieved by any other means. After presenting the different types of (international) surrogacy that can be practiced and the terms of the public debate on this issue, I consider the ethical and legal problems of international surrogacy. I wonder whether it is compatible with the vulnerability principle and the dignity and human rights of the people affected, who are: (1) the children resulting from international surrogacy, (2) the woman carrying the baby, (3) the intended parent/s. I conclude that a regulation of this practice would be insufficient and a universal agreement to forbid would be the right answer.
