Resumen de Specialised adjudication in EU Administrative Law : the boards of appeal of EU Agencies

Paola Chirulli, Luca De Lucia

  • The article examines the Boards of Appeal entrusted with the task of reviewing administrative decisions of EU agencies. After describing the common features of the Boards of Appeal and identifying some of the open issues regarding their role and activity, two reference models (drawn from the UK and the US legal orders) will be looked at in order to help provide a better analysis of their EU counterparts. The study will then focus on the fact-finding and decisionmaking activities carried out by the Boards of Appeal, with the aim of assessing the type and intensity of their powers of review. Finally, the balance between public and private interests produced by these dispute resolution mechanisms will be considered, as well as their contribution to the gradual shift of the EU system of right protection towards partial specialisation.
