    Vamos a tratar la protección de las víctimas tras la promulgación del Estatuto de la víctima del delito, que transpone la Directiva 2012/29/UE y codifica los derechos procesales y extraprocesales de las víctimas. Estudiaremos si existen buenas prácticas en el Derecho español en esta materia. Los problemas derivados de la antigüedad de la Ley de Enjuiciamiento Criminal de 1882 y la dispersión normativa, requieren una seria y precisa regulación de la materia. El Estatuto reforma la Ley de Enjuiciamiento Criminal, siendo relevantes las innovaciones que introduce en el tratamiento de las víctimas con necesidades especiales de protección y en la protección de la víctima durante las fases de investigación y enjuiciamiento. El Estatuto respeta y supera las normas mínimas de la Directiva e introduce importantes novedades, pero existen extremos que no están lo suficientemente precisados, lo cual junto con la carencia de medios y recursos, puede obstaculizar la eficacia y aplicación práctica de la nueva normativa.

    We are going to study the protection of victims following the enactment the Crime victim Statute. The Statute transposes the Directive 2012/29/UE, and codifies the procedural and extra-procedural rights of victims. We are to investigate if good practices exist in Spanish Law. The problems derived from the antiquity of the Act of Criminal Procedure of 1882 and the multiplicity of the regulations, require a new, serious and precise regulation of the matter. The Statute reform the Act of Criminal Procedure, being relevant the innovations in the treatment of victims with specific protection needs and the protection of the victim during criminal investigations and court proceedings. The Statute respects and exceeds de minimum standards of the Directive and introduces important innovations, but there are extremes which are not sufficiently specified, which together with the lack of means and resources, it can hinder the effectiveness and practical application of the new regulation.
