Resumen de Democracy and constitutionalism in times of crisis: an exploratory essay on the constitutional function developed by the EU

  El objetivo de este artículo es analizar los argumentos de aquella literatura que afirma que, especialmente en tiempos de crisis, la integración de la UE pondría en peligro los pilares del Estado democrático, limitando el espacio de acción de los parlamentos nacionales y sofocando la �voz� de otros actores relevantes a nivel estatal. En mi opinión, esta interpretación describe solo parcialmente la realidad. Con referencia a su estructura, este artículo se divide en tres partes: en primer lugar, haré una introducción sobre la actual gobernanza económica de la Unión Europea, haciendo hincapié en el Tratado de Estabilidad, Coordinación y Gobernanza en la Unión Económica y Monetaria (TECG). En segundo lugar, analizaré el impacto de estas medidas anti-crisis sobre unos actores clave de la democracia del Estado nacional, es decir, los parlamentos nacionales y las entidades regionales. Por último, trataré de explicar por qué la acción de la UE podría ser descrita como correspondiente a los ideales del constitucionalismo y en que sentido esta reconstrucción puede conciliarse con la interpretación tradicional de la función constitucional.

  The aim of this article is to analyze the arguments a certain thread of literature according to which, especially in times of crisis, the EU integration would be jeopardizing the cornerstones of State democracy, limiting the space for parliamentary intervention and suffocating the �voice� of other key actors at the national level. In my view, this is only partly true. As for its structure, this article is divided into three parts: firstly, I will offer an introduction to the current European Union economic governance, paying attention to the Treaty on Stability, Coordination and Governance in the Economic and Monetary Union (TSCG). Secondly, I shall say something on the impact of these measures on the key actors of the national State democracy, namely national parliaments and regional entities. Finally, I will try to explain why the action of the EU might be described as corresponding to the ideals of constitutionalism and why this can be reconciled with the traditional understanding we have of the constitutional function.
