La nueva arquitectura del ejecutivo en la constitución marroquí de 2011

    Este artículo analiza la arquitectura del ejecutivo en la constitución marroquí de 2011, que procede, en primer lugar, de los novedosos rasgos que caracterizan la implementación de las potestades reales en la nueva norma fundamental. En segundo lugar, el reciente estatuto del Gobierno pone de manifiesto la nueva construcción del ejecutivo, que en Título V de la carta magna queda ahora bajo su dirección. Los conceptos de renuncia, compartición y delegación parecen describir un método de gobernanza que identifica el nuevo modelo de ejercicio de las distintas prerrogativas de la Monarquía. La institución gubernamental subraya la procedencia del Gobierno de la mayoría parlamentaria. También como novedad tiene potestades ejecutivas ejercidas en el marco de la constitucionalización de nuevos conceptos de gobernanza que de hecho se entienden, solamente, en relación con la cadena de textos precedentes, y que adoptan un enfoque global de la reciente norma jurídica.

    This article discusses the construction of a new Executive within the Moroccan Constitution of 2011. A new structure of governance flows, first, from the new features that characterize the implementation of the Royal powers in the new foundational law. Second, the new government statute highlights the novelty of the executive structure. Section V of the new Constitution highlights the importance of Executive power, which is for the first time under the Government�s direction. The concepts of renunciation, sharing and delegation seem to describe a new method of governance including specifying a new model for the exercising of the various distinct powerss of the Monarchy. Section V of the Constitution, also stresses the relationship between obtaining a parliamentary majority and the constitution of a Government. It also notes, some novel Executive powers exercised under the Constitution that can actually only be understood in relation to the chain of preceding texts that adopt a comprehensive approach to the new Constitution.
