In principle, Canadian taxation law trusts the taxpayer. It relies on a system of self-reporting and self-assessment. Nevertheless, this trust has limits. Given the importance of the tax system for the activities of a modern State and for its financial equilibrium, Canadian taxation law grants tax authorities broad powers of audit and investigation, accompanied by important penal sanctions. This system is itself subject to the constitutional guarantees established under the Canadian Charter of Rights and Freedoms. The jurisprudence of the Canadian courts has recognized the constitutional validity of the audit and investigation powers of the tax authorities. But the courts have also stated that the imposition of penal sanctions triggers the application of the constitutional guarantees relating to the criminal justice system. Courts have sought to determine at what point these guarantees start to apply during the audit and investigation process. They have established a complex and perhaps precarious balance between the necessities of public administration and the basic rights and interests of the taxpayer.
En principe, la législation fiscale du Canada fait confiance au contribuable. En effet, sa mise en ceuvre repose sur un système de déclaration volontaire et d'auto-cotisation. Toutefois, cette confiance connaît des limites. Ainsi, en raison de I'importance de la fiscalité pour les activités d'un État moderne et pour ses équilibres financiers, le législateur a accordé à I'administration fiscale des pouvoirs de vérification et d'enquête étendus, appuyés par des sanctions pénales importantes. Ce système se trouve lui-rnême assujetti au régime de garanties constitutionnelles établies en vertu de la Charte canadienne des droits et libertés. Si la jurisprudence a reconnu la conformité constitutionnelle du système de vérification et d'enquête, elle a aussi souligné que le recours aux sanctions pénales entraînait l'application des garanties constitutionnelles relatives à la justice pénale. Elle a cherché à résoudre les difficultés résultant du passage des mesures administratives aux sanctions pénales. EIle a établi un équilibre complexe et peut-être précaire entre les besoins de l'administration publique et les droits et intérêts des contribuables.
