    Este artículo analiza el problema tanto de la proscripción, comode la justificación de la guerra civil. En primer lugar, examina la naturaleza dedicha prohibición normativa en la fundamentación del Estado moderno, altiempo que esboza algunas ideas que disienten de una defensa acérrima eincondicional del aparato de Estado. En segundo lugar, analiza el argumentode Vattel sobre el derecho de rebelión como excepción cuando tiene lugar unaopresión abierta y manifiesta. Por último, discute en breve el problema de laopresión política y social como fuente legítima de causa belli dentro del Estado.Para ello sugiere un concepto amplio de opresión en el que se identifican susdistintas caras. Además, examina concisamente las respuestas violentas a losdistintos tipos de opresión y analiza la disyuntiva entre el derecho a la vida yotros derechos en el contexto de una opresión visible y en el momento dedecidir alzarse en armas contra el soberano o contra una fracción de ciudadanos.

    This essay analyse the problem of proscription as well as justification of civil war. Firstly, it examines the nature of such normative prohibition within the grounds of the modern state. At the same time, some ideas against the staunch and unconditional defense of state apparatus will be outlined. Secondly, it analyses Vattel's view on the right to rebellion as an exception when open and manifest oppression occurs. Finally, it briefly discusses the problem of political and social oppression as a legitimate source of causa belli within the state. To that end, it suggests a wider concept of oppression which identifies different oppression features. Futhermore, it examines concisely violent responses to different types of oppression, and study the disjunction between the right to life and other rights in the context of visible oppression and at the moment of making the decision to take up arms against the soverign or against another part of fellow citizens.
