    Este trabajo aborda la circunstancia agravante de responsabilidad penal contemplada en el artículo 72 del Código Penal (en adelante, CP), que consiste en prevalerse de un menor de edad para la comisión de un delito. Apoyado en antecedentes doctrinales, históricos y jurisprudenciales, el autor examina la estructura y los fundamentos de este elemento circunstancial y valora críticamente las soluciones que la doctrina y la praxis judicial proponen frente a los diversos problemas que trae consigo su aplicación.

    This work approaches the aggravating circumstance of criminal liability in article 72 of the Penal Code, which consists of taking advantage of a minor for the commission of a crime.

    Supported on doctrinal, historical and jurisprudential precedents, the author examines the structure and the foundations of this circumstantial element and critically evaluates the solutions that both doctrine and judicial practice propose against the diverse problems that its application brings.
